Dear Public Official,

Please be advised that the Illinois Department of Labor has posted updated prevailing wage rates for each Illinois county , as required by the Illinois Prevailing Wage Act.  The posted rates are required to be paid for work performed in the relevant county on or after August 15, 2018 by laborers, workers, and mechanics employed on public works projects.  

 As we have advised in previous communications, public bodies are responsible for notifying all contractors and subcontractors performing work for the public body on active public works projects of changes (if any) to rates relevant to such projects.   See ILCS 130/4(d).

PLEASE NOTE:

The Prevailing Wage Act (820 ILCS 130/0.01-12) requires contractors and subcontractors to pay laborers, workers, and mechanics employed on public works projects no less than the general prevailing rate of wages (consisting of hourly cash wages plus fringe benefits) for work of similar character in the locality where the work is performed.

Pursuant to 820 ILCS 130/4, public bodies with active public works projects are responsible for notifying all contractors and subcontractors working on those public works projects of the change (if any) to the rates that were previously in effect. The failure of a public body to provide such notice does not relieve contractors or subcontractors of their obligation under the Prevailing Wage Act, including the duty to pay the relevant prevailing wage in effect at the time work subject to the Act is performed.
